Terms of Service

These Terms of Use (“Terms”) govern your access to and use of the Ear Training – Sound Clarity mobile application (“App”), provided by Health Fitness Medical IT Solutions (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By using the App, you represent and warrant that you meet this requirement.

2. License and Allowed Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on a device that you own or control
  • Use the App for personal, non-commercial purposes only

You agree not to:

  • Copy, modify, distribute, or sell any part of the App
  • Reverse engineer, decompile, or attempt to extract the source code (except where permitted by law)
  • Circumvent any security or technical protection in the App
  • Use the App in any way that violates applicable laws or regulations

3. No Medical Use and No Medical Advice

The App is designed for sound training, listening comfort, and audio-related practice only.

  • The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or hearing condition.
  • Any results, simulations, or “tests” inside the App are for informational and self-training purposes only.
  • The App does not replace a professional hearing examination or medical consultation.

If you have any concerns about your hearing or health, you should consult a qualified audiologist or medical professional. You should never ignore professional advice or delay seeking it because of anything you see or hear in the App.

4. In-App Purchases and Subscriptions

The App may offer paid features, one-time purchases, or subscriptions via the App Store or other platforms.

  • All billing and payment processing are handled by the platform provider (e.g., Apple App Store), not directly by us.
  • Please refer to the platform’s terms and policies for payment, subscription renewal, and refund rules.
  • Certain features may only be available while you have an active subscription or valid purchase.

We reserve the right to change available features, pricing, and subscription terms at any time, in accordance with platform rules.

5. User Content

The App may allow you to create or store content locally on your device (e.g., recordings, notes, transcripts).

  • You are solely responsible for the content you create, store, or share while using the App.
  • You must ensure that your use of recordings and transcripts complies with all applicable laws, including privacy and consent laws in your jurisdiction (for example, when recording other people’s voices).

We do not access your local content unless you explicitly share it with us (for example, when sending files to support).

6. Prohibited Conduct

You agree not to use the App to:

  • Violate any local, national, or international law or regulation
  • Record or monitor individuals without proper consent where required by law
  • Harass, abuse, or harm others
  • Introduce viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or third-party systems

7. Third-Party Services and Links

The App may integrate or interact with third-party services (e.g., analytics, app store services, system-level speech recognition).

We are not responsible for the content, policies, or practices of third-party services. Your use of such services is governed by their respective terms and privacy policies.

8. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability of the App

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Any defects or errors will be corrected
  • The App will meet your expectations or specific needs

You use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Health Fitness Medical IT Solutions and its officers, employees, and partners shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or other intangible losses

10. Termination

We may suspend or terminate your access to the App at any time, without notice, if:

  • You violate these Terms
  • The App is discontinued
  • Required by law or platform rules

Upon termination:

  • Your license to use the App ends immediately
  • You must stop using and delete the App from your devices

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws applicable in the jurisdiction where Health Fitness Medical IT Solutions is registered, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms periodically.

Changes take effect once published (within the App or on a designated website).

Your continued use of the App constitutes acceptance of the updated Terms.
